Your Rights and Obligations

This document contains our complete User Agreement. We recommend printing this page for your records. This Agreement establishes the terms and conditions governing your access to the directlistings.us website ("Site") and text message services ("Text Messaging"). Your use of this Site signifies your acceptance of these Terms of Service ("Terms"). Standard message and data rates may apply for Text Messaging services.

While registration is not required to view benefits available through this Site, only registered users of paid services can access the complete features and services offered by directlistings.us. By registering, you agree to provide (i) truthful, accurate, current, and complete information as requested during registration, and (ii) maintain and update your account information to ensure it remains accurate and current.

If you provide false, inaccurate, outdated, or incomplete information, or if we have reasonable grounds to suspect such, or if you violate these Terms (as determined at our sole discretion), we reserve the right to suspend or terminate your registration and deny any current or future use of the Site and Services.

Subscription Fees and Charges

Certain Site features are accessible only through purchased subscriptions ("Fee-Based Services"). By choosing to use Fee-Based Services, you agree to pay all applicable subscription charges using a valid credit card, including daily, weekly, monthly, or annual fees as specified on the Site, plus any additional charges incurred on your account.

If your registration includes a trial period, following the trial's conclusion and each month thereafter until cancellation, the membership fee will be automatically charged to the credit card you provided and authorized at registration. The renewal charge will reflect the then-current published rate for your subscription term.

If we cannot successfully charge your account, we reserve the right to either continue billing attempts or terminate your access to Fee-Based Services at our sole discretion. You may be subject to a pre-authorization when ordering membership. THIS PRE-AUTHORIZATION IS NOT AN ACTUAL CHARGE but may reserve the applicable subscription amount against your available credit limit. Contact your card issuer for additional details.

Pricing Details

At its sole discretion, directlistings.us may offer different subscription terms and pricing that may vary from time to time. Site content and various services, whether provided by directlistings.us, third-party providers, or others, may require additional fees.

Cancellation and Refund Policy

You may cancel your subscription through the following methods:

Customer Service Hours:

• Monday – Friday: 5 AM to 6 PM Pacific Time
• Saturday – Sunday: 7 AM to 3:30 PM Pacific Time

All service fees are non-refundable.

Mobile Terms and Conditions

directlistings Alerts: Receive exclusive text offers and deals through your mobile device. Opt-in via web or text JOIN to designated shortcodes to receive up to 1 text message daily with property alerts, marketing messages, and service-related updates. Standard message and data rates apply.

By opting in, you consent to receive mobile text alerts using an automatic telephone dialing system. Consent to receive marketing texts is not required to purchase goods or services. By signing up, you confirm you are over age 13.

To Stop Messages: Text STOP to the shortcode to cease receiving messages (you'll receive a confirmation).

Limited Use of IDX and Broker Price Opinion Data

By registering as a customer of directlistings.us, you acknowledge and agree to the following:

1. Broker Affiliation & Platform Use

You acknowledge that directlistings.us utilizes proprietary data, software, and technology owned and operated by licensed real estate brokers for displaying and promoting real estate listings, including those obtained via Multiple Listing Services (MLS).

2. Broker Price Opinion (BPO) Data

You understand that various data presented on directlistings.us—including listings, property descriptions, amenities, comparable sales, historical pricing, market statistics, and marketing media—constitute Broker Price Opinion data ("BPO Data") created or derived by the brokerage.

3. Authorized Access & Intended Use

Such BPO Data is available only to current and prospective clients through secure login, solely for evaluating real estate opportunities.

4. Relationship with Brokerage

By accessing directlistings.us, you acknowledge you are considering—but are under no obligation to enter into—a fee-for-service, buyer/seller representation, or referral-based relationship with the brokerage or its affiliates.

5. Restrictions on Use

All Data is for your personal, internal use only. You may not:

• Copy, reproduce, redistribute, sublicense, or resell the Data
• Share, license, or commercialize the Data
• Use automated tools to scrape or collect Data from the platform

6. Ownership and Rights

You acknowledge the applicable MLS's ownership of and copyright in the IDX Data. Neither directlistings.us nor its data licensors warrant the accuracy, completeness, or reliability of the Data.

Copyright and Trademarks

All Site materials, including text, images, software, databases, and services (collectively, "Content"), are owned or controlled by directlistings.us and its content suppliers. This Content is protected by United States and international copyright and trademark laws.

Unless otherwise permitted, you may not download, display, reproduce, create derivative works, transmit, sell, distribute, or exploit the Site or any portion thereof for public or commercial use without prior written permission from directlistings.us.

Information Accuracy

You acknowledge that reliance upon any advice, opinion, statement, or information displayed through the Site is at your sole risk. Information is provided solely for informational purposes and does not constitute an offer to sell, rent, or advertise real estate.

While information is deemed reliable, it is not guaranteed and should be independently verified. Neither directlistings.us nor its affiliates shall have any liability arising from your purchases based upon Site information.

We reserve the right to correct errors or omissions and to deny Site access to anyone at any time without notice.

Age Requirements

You represent and warrant that you are at least eighteen (18) years old and possess the legal right and ability to enter into this Agreement and use the Site in accordance with these Terms.

Equal Housing Opportunity

Property owners and managers are subject to the Fair Housing Act, which prohibits discrimination in the sale, rental, and financing of dwellings based on race, color, religion, sex, handicap, familial status, or national origin.

directlistings.us supports Equal Housing Opportunity and encourages users to follow appropriate guidelines to comply with both Federal Fair Housing Act and applicable state and local regulations.

Property Owner and Manager Responsibilities

As a property owner or manager, you have a legal responsibility not to discriminate in property sales or leases. You cannot establish discriminatory terms, deny housing availability, or advertise property as available only to certain groups based on protected characteristics.

Home Buyer and Renter Rights

As someone seeking to buy or lease property, you have the right to expect:

• Housing available without discrimination based on protected characteristics
• Equal professional service
• Broad range of housing choices
• No discriminatory limitations on communities or locations
• No discrimination in pricing or financing
• Reasonable accommodations for persons with disabilities
• Freedom from harassment for exercising fair housing rights

Mandatory Arbitration and Class Action Waiver

You agree that, except for injunctive relief sought by directlistings.us for proprietary rights violations, any dispute relating to these Terms, the Privacy Policy, or your use of the Site shall be resolved by binding individual arbitration conducted in accordance with American Arbitration Association (AAA) rules by an independent arbitrator. Arbitration location shall be Los Angeles County, California, USA.

These arbitration obligations apply to all disputes involving directlistings.us, its affiliates, and third parties it works with. This includes disputes arising from torts, fraud, misrepresentation, negligence, or violation of statutes.

All arbitrations shall be conducted on an individual basis. You acknowledge and agree that these Terms prohibit you from initiating arbitration as a representative of others or joining arbitration initiated by another individual. You waive your right to act as a class representative or member of a class action.

Modifications to Terms and Services

directlistings.us reserves the right to modify this Agreement and any policies affecting the Site at its sole discretion. Modifications become effective immediately upon posting to the Site or distribution via email or mail. Your continued use following notice of modifications constitutes acceptance.

We also reserve the right to modify, suspend, or discontinue the Site or any portion thereof at any time without notice or liability. We may impose limits on certain features or restrict access to parts or all of the Site.

Your only recourse regarding dissatisfaction with modifications is to cancel your subscription.

Governing Law

These Terms are governed by and interpreted in accordance with the laws of the State of California, without regard to choice of law provisions.
